District Administrative Judge and Suffolk County Traffic and Parking Violations Agency Secure Administrative Order to Address the Most Egregious Traffic Violators

Judge C. Randall Hinrichs, District Administrative Judge of Suffolk County, and the Suffolk County Traffic and Parking Violations Agency (SCTPVA)  have worked collaboratively to develop an administrative order to address the most egregious traffic infraction violators.

“This will ensure that the most serious traffic cases are handled at the District Court level and that those defendants facing jail will have immediate access to legal representation,” stated Judge Hinrichs.

The Administrative Order will address any case pending in SCTPVA where:

  • The Suffolk County Traffic and Parking Violations Agency independent prosecutor will recommend a jail sentence or bail: or
  • A Judicial Hearing Officer determines that incarceration may be appropriate: or
  • Where bail may be imposed or a Warrant is returned.

This administrative order will help to ensure that individuals facing possible incarceration will have immediate access to legal counsel.  At any given time, District Court has on hand legal aid attorneys and 18-B attorneys to assist defendants.

“SCTPVA believes that the District Court is in the best position to sentence dangerous drivers and I am pleased that we have been able to create a mechanism that would allow that process to commence,” said Paul Margiotta, Executive Director-Suffolk County Traffic and Parking Violations Agency.
